In August 2006, the Department of Health and Human Services (HHS) published rules providing an exception to the physician self-referral prohibition (commonly referred to as the Stark law) and a safe harbor under the anti-kickback statute. These provisions allow hospitals, health systems, health plans and others to donate EHR software to physicians and other healthcare practitioners under specified conditions, one of which is that the software must be interoperable. EHR software is deemed to be interoperable if a certifying body recognized by the Secretary of HHS has certified the software. CCHIT is an officially recognized certifying body.
